What is a student intern?
A student undergoing a period of work arranged/endorsed by an education institution in connection with an accredited programme being provided by the institution to the student or resident in Hong Kong and undergoing a period of work arranged or endorsed by an institution.
A student undergoing a period of work in connection with a non-local education programme being provided by the institution to the student, for which the work is a compulsory/elective component of the requirements for the award of the academic qualification to which the programme lead
The minimum wage does not apply to student interns, therefore you would not be entitled to it. This means it will be unpaid work unless you have an employment relationship
with the host organisation/company.
It also does not apply to work experience students during a period of exempt student employment.
To be an exempt work experience student, they should be under the age of 26 at the beginning of employment, and that period of exemption cannot be more than a continuous period of 59 days. The student employee needs to make a statutory declaration verifying that there is only one period of exempt student employment during the same calendar year, and provide the declaration (or copy) to the employer.
The exemption from the Statutory Minimum Wage does not apply if a work experience student has not agreed with the employer to treat a certain period as a period of exempt student employment.
